Compliance Only Works If Subbies Understand It

by | Jul 19, 2025

The best contract in the world means nothing if your subcontractors don’t get it.
Most construction firms get the paperwork sorted.

Contracts, status determinations, UTRs on file, maybe even a software system behind it. But here’s the bit that gets missed – and it’s where everything can fall apart:

If your subbies don’t understand what they’ve signed, what they’re agreeing to, or why it matters… then it’s not compliance. It’s confusion. And when things go wrong, confusion is expensive.

HMRC don’t just care about the paperwork. They care about whether the reality reflects what’s on the page.
So if you’ve got a contract saying one thing…but the subbie on site is saying something completely different… That’s a red flag. And HMRC will use it to challenge everything.

Real-world example: Liam’s crew

Liam runs a civils company with 25 subbies. He got a solid contract drawn up. Sent it by email. Everyone signed. Job done.

Or so he thought.

When HMRC opened an enquiry, they interviewed a couple of lads on-site.

“Nah, we don’t really run our own business. We just show up when Liam tells us to.”

And just like that, the contracts were worthless.

Why?

Because Liam hadn’t explained what self-employment actually meant. He hadn’t made sure the subbies were working in a way that backed up the contract. HMRC saw the disconnect and came after him.

The myth of “just get it signed”

A common misconception is that a signed contract = protection. Too many firms treat compliance like an admin job.

“Send the contract. Get the signature. Tick the box.”

But that’s not how it works anymore. If the subbie:

  • Didn’t read it properly
  • Didn’t understand it
  • Wasn’t given any explanation

…then that contract doesn’t hold up the way you think it does.

Even worse? If HMRC interview your subbie and hear “I dunno, I just signed what they sent me,” it undermines your whole setup.

Real compliance means real understanding

IThe firms we work with aren’t trying to trip their subbies up. They’re trying to:

  • Do things properly
  • Build long-term relationships
  • Avoid future HMRC stress

But if your setup feels like a whole load of legal waffle and red tape, you lose trust before a shovel even hits the ground.

So how do you fix it?

It’s not about dumbing it down. It’s about clear communication.

If you already know that your subbies are skilled but not particularly paperwork people, then it makes sense that instead of dumping a 10-page PDF on them and hoping for the best, you:

  • Sent a WhatsApp message first to explain what’s coming
  • Use a mobile-friendly signing link
  • Share a 60-second video explaining the setup in plain English
  • Answer common questions before anyone panics

That way, subbies know the score. They understand what’s expected. And when HMRC come sniffing, they give answers that match the contract.

That’s what real compliance looks like.

Here’s what we tell every firm we work with:

A confused subbie is a liability. An informed one? A strength.

That’s why we don’t just do contracts at HardHats. We build systems.

  • Paperwork that actually reflects reality
  • Processes that make sense on-site
  • Communication tools that build trust instead of breaking it

Because when your subbies get it, your setup stands strong.

Final thought

Compliance isn’t just about ticking boxes. It’s about making sure your business is protected – and your team (including your subbies) are on side with you, not confused by you. Because the strongest setups are the ones everyone understands.

You can have the best legal support, the fanciest contract and all the right jargon.

But if one subbie shrugs at an HMRC interview and says,

“No idea what that contract meant, mate”

you’ve got a problem.
