Basically, we excel at creating water-tight contracts that reflect the true working relationship between you and your subcontractors so they can never be misconstrued as employees. And because we excel at this, we offer a full, insurance-backed guarantee.
If HMRC ever says that your subcontractors should be reclassified as employees, we’ll handle the enquiry and pay any associated costs (PAYE NICs, interest and penalties). In short, HardHats take full responsibility for your subcontractors’ employment status, so you can use subcontractors for as long as you want, however you want.

Markel is a multi-billion dollar international insurance company that specialises in ‘hard-to-place’ risks. They also have a history of successful selfemployment cases against HMRC, which is the basis for the HardHats guarantee.
They are involved in the process from day one, and underwrite all our contracts before the guarantee is issued. And because they are involved from the start, they will never fail to pay should HMRC reclassify your subcontractors as employees.
Your side of the deal
For us to offer the HardHats guarantee, you have to do three things:
- Be completely honest about the true working relationship between you and your subcontractors
- Get all your subcontractors to sign one of our contracts
- Pay our invoices on time
If you do those things, you can use your subcontractors for as long as you want and keep HMRC happy without using a payroll company.
